1.1) ‘Buyer’ means the person that is named on the invoice.
1.2) ‘You’ means the buyer
1.3) ‘We’ ‘Our’ means MJS Fabrication
1.4)’Invoice’ This is the document titled ‘ Invoice’ received on completion of the ‘Contract’
1.5) This is a legally binding agreement between the buyer & MJS Fabrication
1.6)’Contract’ this term refers to any legally binding agreement between MJS Fabrication & the buyer
1.7) ‘Goods’ and ‘Products’ are the physical items detailed on the invoice
1.8) ‘ End User’ this is the person who will use the goods-not necessarily the buyer
2. Terms & Conditions of Sale:
2.2) Payment can be made by either BACS, Cheque or Cash.
2.3) The Goods ordered by the buyer will be despatched upon receipt of payment from the buyer, to the address specified on the order.
2.4) MJS Fabrication reserve the right to change or modify any of their products without prior notice.
2.5) If the buyer has not received the goods in accordance with the invoice then it is the responsibility of the buyer to inform MJS Fabrication of any suspected discrepancy.
2.6) Postage & Packing prices are for UK Mainland only.
3.Receipt of Products:
3.2) If the buyer is not the end user then its is the buyer’s responsibility to ensure the end user is aware of all terms of this contract-in particular the conditions as to the use of the product.
3.3) MJS Fabrication accepts no responsibility for any loss arising out of negligent use of the products by the end user or by any third party.
4.2) The provisions of this clause (clause 4) shall be construed seperately, applying and surviving even if got any reason one or all the other clauses are demmed inapplicable or unenforceable in any circumstances and shall remain in force not withstanding the expiry or termination of our agreement.
5. MJS Fabrication Products & Services:
5.2) The effectiveness of MJS Fabrication goods & products depends on the user, in most cases the desired effects are achieved. However, there is no guarantee of their effectiveness in every case.
6. Privacy Statement:
6.2) MJS Fabrication will not pass any personal information to third parties without your prior consent.
6.3) You have the right to access the personal data we hold about you at any time.
6.4) You should be aware that if we are requested by the Police or any regulatory or government authority investigating suspected illegal activities, we may be enforced to supply customers personal information, which we shall.
6.5) We also reserve the right to disclose individually identifiable information to third parties where a complaint arises concerning your dealings with MJS Fabrication and those dealings are deemed by us inconsistent with our terms and conditions.
7.2) We regret that we are unable to refund the cost of bespoke alloy parts made to a customer;s specification unless the part is faulty and beyond repair by MJS Fabrication.
7.3) Bespoke items that can possibly be resold may be returned for a 25% restocking fee.
7.4) The decision of MJS Fabrication is final.
7.5) Your statutory rights are not affected.
8. Applicable Law:
8.2) If you have any queries regarding these terms then please contact MJS Fabrication at firstname.lastname@example.org. We will try and resolve any queries as soon as possible.
8.3) Each of the clauses of these terms & conditions shall be construed seperately (unless otherwise stated) and independently of each other. Invalidity of any one part shall not affect the validity of any other part.
8.4) This agreement shall not be governed by the laws of England and you agree to submit exclusive jurisdiction of the English courts.
8.5) Your statutory consumer rights are not affected by these terms and conditions.
